The FTC and FCC are independent agencies, so they can take action. If the FCC imposed rules, experts say it would be challenged in court. The Communications Decency Act was supposed to determine who can or can't be sued, according to the Electronic Frontier Foundation's senior legislative counsel.
The law does not give the FCC or other federal agency the authority to limit what an online company can or cannot do. It's not clear if the FCC will propose new regulation. This a very important debate.
